2. User Eligibility and Account Creation

2.1 Eligibility: To use ProSkins, you must be at least 16 years of age. Users under 18 must obtain consent from a parent or legal guardian to access and use the platform. By accessing ProSkins, you confirm that you meet this requirement.

Additionally, ProSkins services are not available to users located in, or residents of, any countries or regions subject to U.S. sanctions, including but not limited to:

- Cuba

- Iran

- North Korea

- Syria

- Crimea Region (Ukraine)

- Russia

- Belarus

- Venezuela (specific government officials and sectors)

- Any other country or individual on the U.S. Department of Treasury's Office of Foreign Assets Control (OFAC) sanctions list.

By using ProSkins, you confirm that you are not located in, under the control of, or a national or resident of any of these countries or subject to such restrictions.

2.2 Steam Integration: You are required to link your Steam account to ProSkins to trade or sell in-game items. By linking your Steam account, you authorize ProSkins to access your Steam account information (e.g., profile, inventory) on an ongoing basis to facilitate transactions.

2.3 Account Security: You are solely responsible for maintaining the security of your ProSkins account. Sharing account credentials or allowing third parties to access your account is strictly prohibited. You must immediately notify ProSkins if you suspect any unauthorized use of your account. ProSkins disclaims liability for damages resulting from unauthorized access.

2.4 Account Suspension and Termination: ProSkins reserves the right to suspend or terminate accounts at its discretion. Grounds for termination include but are not limited to, violation of this Agreement, illegal activity, or fraudulent behavior. Termination may result in the forfeiture of any balance or virtual items associated with your account.

3. User Conduct and Responsibilities

3.1 Prohibited Conduct: Users are required to follow all applicable local, national, and international laws. The following behaviors are strictly prohibited:

• Using automated tools such as bots, scripts, or hacks to manipulate the platform.
• Harassing, threatening, or otherwise abusing other users.
• Engaging in fraudulent behavior, including misrepresenting identity or virtual items.
• Uploading or sharing offensive, harmful, or illegal content (e.g., pornographic material, malware, viruses).
• Attempting to manipulate prices or cause disruptions to the marketplace.
• Impersonating other users, ProSkins staff, or using deceptive identities.

3.2Content Responsibility: You are solely responsible for any content you upload, share, or otherwise provide through the platform. ProSkins reserves the right to remove content that violates this Agreement or applicable laws.

3.3Fair Use Policy: Users agree not to use ProSkins in ways that could harm the platform’s integrity, disrupt services, or impose excessive demands on the system. ProSkins reserves the right to limit access or suspend accounts for misuse under this policy.

4. Virtual Item Transactions

4.1 Role of ProSkins: ProSkins acts solely as an intermediary, providing a platform for users to buy, sell, and trade virtual in-game items. We do not take ownership of any virtual items and are not responsible for the accuracy or fulfillment of user transactions.

4.2 Transaction Fees: A 5% transaction fee will be charged on all sales, deducted from the seller’s earnings. There is no transaction fee for buyers. Fees are non-refundable and subject to change at our discretion.

4.3 Finality of Transactions: All sales and trades conducted through ProSkins are final. No refunds or reversals will be issued once a trade has been completed. It is the responsibility of the user to ensure the accuracy of the trade details before finalizing the transaction.

4.4 Penalties for Incomplete Transactions: If either party fails to meet their obligations (e.g., failure to deliver the item or payment), ProSkins may impose a penalty of up to 4% of the transaction value. Repeated failure may result in account suspension or termination.

5. Payment, Deposits, and Withdrawals

5.1 Payment Methods: ProSkins accepts a variety of payment methods, including credit cards, PayPal, and cryptocurrency. Payments are processed by third-party providers, and ProSkins is not liable for any issues arising from payment processing failures. Users are subject to the payment processor’s terms and conditions.

5.2 Deposits: Users can deposit funds into their ProSkins wallet. The minimum deposit amount is $10 USD. Deposited funds cannot be withdrawn unless earned through the sale of virtual items. Deposits made using credit cards may require additional verification (KYC).

5.3 Withdrawals: Users may withdraw funds from their ProSkins balance provided they meet the minimum threshold of $10 USD. Withdrawals are processed within 24-48 hours, though delays may occur during high transaction volumes. All withdrawals are subject to successful completion of KYC (Know Your Customer) procedures.

5.4 KYC and AML Compliance: In compliance with Anti-Money Laundering (AML) regulations, ProSkins requires users to verify their identity before making withdrawals. The KYC process may involve submitting government-issued identification, proof of address, and other verification documents.

5.5 Refund Policy: Due to the nature of digital goods, all sales are final, and refunds will not be issued under any circumstances. Users should review transactions carefully before finalizing any trade.

6. Fraud Prevention and Security

6.1 Account Monitoring: ProSkins actively monitors accounts for signs of suspicious or fraudulent activity. Any activity deemed suspicious, including unusual login locations, multiple failed transactions, or attempts to manipulate the platform, may result in the temporary suspension or permanent termination of the user’s account.

6.2 Disputes Between Users: ProSkins may mediate user disputes, but we are not obligated to resolve them. Users can initiate disputes through the platform, and both parties may be required to provide supporting evidence. However, ProSkins is not obligated to resolve disputes and makes no guarantees regarding the outcome.

6.3 Liability for Losses: ProSkins is not liable for any financial losses incurred due to fraudulent activity, unauthorized access to accounts, or system outages. Users are responsible for maintaining the security of their own accounts and taking precautions against phishing and other cyber threats.

7. Intellectual Property and Content Ownership

7.1 ProSkins Content: All content and intellectual property on the ProSkins platform, including but not limited to logos, images, code, and trademarks, is owned by ProSkins. Users are granted a limited, non-exclusive, non-transferable license to access and use the platform for personal purposes.

7.2 User Content: By uploading or sharing content on ProSkins, you grant ProSkins a royalty-free, perpetual, irrevocable license to use, display, and modify your content for the purposes of providing the Service. You are responsible for ensuring that you have the rights to share any content you upload.

8. Data Privacy and Security

8.1 Data Collection: ProSkins collects personal data such as name, email, payment information, and Steam account details for the purposes of facilitating transactions, preventing fraud, and improving service quality. All data is handled in accordance with our Privacy Policy.

8.2 Data Use: We use your data to verify identities, process transactions, and communicate with you regarding your account. ProSkins employs industry-standard security measures to protect your data from unauthorized access.

8.3 Data Sharing: We may share your data with third-party providers, such as payment processors and identity verification services, to facilitate transactions. ProSkins does not sell personal data to third parties.

9. Disclaimers and Limitation of Liability

9.1 No Warranty: ProSkins is provided on an “as-is” and “as-available” basis. We make no warranties or guarantees regarding the availability, performance, or accuracy of the platform. We do not guarantee that transactions will always be completed without error.

9.2 Limitation of Liability: To the maximum extent permitted by law, ProSkins is not liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, virtual items, or account access. In the event of any claim, ProSkins' total liability is limited to the amount you have paid us in the past six months or $100, whichever is less

10. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Delaware, USA.

11. Amendments and Changes to Terms

ProSkins reserves the right to modify these Terms of Use at any time. Users will be notified of changes via the platform. Continued use of ProSkins after the changes take effect constitutes acceptance of the revised terms.
